These Terms & Conditions ("Terms") govern your use of quote.onyxwindowtint.com and the residential and commercial window tinting services provided by ONYX & SONS ("Onyx," "we," "us," or "our"). By using this site, submitting an enquiry, or opting in to our text messaging programs, you agree to these Terms.

1. Enquiries & Eligibility

• You must be 18 years of age or older to submit an enquiry or opt in to text messages.
• You must be the owner of the property, or authorized by the owner to arrange work on it.
• You are responsible for the accuracy of the information you give us. Quotes depend on it.

2. Quotes, Assessments & Pricing

• Submitting a form is a request for information. It is not a contract and does not commit you to anything.
• Any figures given before we see the property are estimates only. A binding price is given in writing after an in-home assessment.
• An in-home assessment is provided free and carries no obligation.
• A written quote is valid for the period stated on it. Prices are in U.S. dollars and exclude tax unless stated.
• If conditions at the property differ materially from what was described, we will tell you and re-quote before doing the work.

3. Scheduling & Installation

• Appointment times are arranged with you in advance. Please give reasonable notice if you need to reschedule.
• You agree to provide safe access to the interior windows to be filmed, and to allow us to move items directly in front of them.
• Installation timescales are estimates and may be affected by access, weather and conditions at the property.
• Film requires a curing period after installation. Haze or small water pockets during curing are normal and are not defects.

4. Warranty & Limitations

• Film is covered by the manufacturer's warranty, which where applicable covers bubbling, peeling, cracking, and colour change. Warranty terms are supplied with your installation.
• We install thermally-stable film certified for the glass type in question and follow the manufacturer's specification. Our installation does not void a window manufacturer's warranty.
• Pre-existing conditions, including failed seals, prior damage, and defective or stressed glass, are excluded. We will point out any we notice before starting.
• The warranty does not cover damage from misuse, abrasive or ammonia-based cleaners, alteration by others, or events outside our control.

5. Text Messaging Program Terms (SMS)

SMS program description and messaging use cases. ONYX & SONS operates two separate text messaging programs relating to window tinting. You may consent to either, both, or neither, and each requires its own separate opt-in:

• Informational / transactional messages — responses to window tinting enquiries submitted on our website, quote details, scheduling and reminders for in-home assessments, and installation coordination.
• Marketing and promotional messages — seasonal offers, promotions and product updates relating to window film, sent only to customers who separately opt in to promotional texts.

How you opt in. You opt in by submitting a form on our website that collects your mobile number and separately checking the consent box for the program you wish to join. Consent boxes are never pre-checked, and consent to receive text messages is not a condition of any purchase or service. By opting in you authorize ONYX & SONS to send text messages to the number you provided, which may be sent using automated means.

Carrier liability disclaimer. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless service provider and is outside our control. We do not guarantee that messages will be delivered.

Age restriction. Our text messaging programs are intended for individuals 18 years of age or older. By opting in you confirm that you are at least 18 years old and that you are the owner or an authorized user of the mobile number you provided.

Supported carriers. Our messaging is supported by major U.S. carriers including AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost, Cricket, MetroPCS and Virgin Mobile, among others.

Privacy. Opting out of one program does not automatically opt you out of the other; reply STOP to the messages you no longer wish to receive. Mobile opt-in data and consent are never shared with third parties for their own marketing purposes. For full details of how we handle your information, see our Privacy Policy.

6. Acceptable Use

You agree not to misuse this website, including by attempting to gain unauthorized access, interfering with its operation, scraping it by automated means, or submitting false information or another person's contact details without their permission.

7. Intellectual Property

The content of this website, including text, images, video and the ONYX name and logo, belongs to ONYX & SONS or its licensors and may not be reproduced without permission.

8. Disclaimers & Limitation of Liability

Information on this website, including heat rejection figures, film specifications and price ranges, is provided for general guidance. Actual performance varies with glass type, orientation and conditions at the property. To the fullest extent permitted by law, our liability arising out of these Terms or any installation is limited to the amount you paid us for the work concerned. Nothing in these Terms limits liability that cannot be limited by law.

9. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in San Joaquin County, California.

10. Changes

We may update these Terms from time to time. The effective date above shows when they were last revised, and any change takes effect when posted on this page.
